Daniel McGregor, 29, had earlier pleaded guilty to reckless driving and four counts of drink-driving causing injury.

He recorded 111 milligrams of alcohol per 100 millilitres of blood when tested. The legal limit is 80mg.

Judge Jonathan Down on Wednesday described how McGregor set off down a steep, winding road at the coastal Hawke's Bay settlement of Waimarama late on January 2 with his seven-year-old daughter, Ashlee Shorrock, string embroidery and three other adults on board.

McGregor's "grossly overloaded" bike was in a poor state of repair and had ineffective brakes as it hurtled out of control on a corner, crashing down a two-metre bank.

All on board were found amidst what police described as a scene of carnage, with multiple broken bones.

Ashlee had a fractured skull and arm and spent time in Auckland's Starship Hospital, while McGregor remains on crutches and is rehabilitating from severely broken legs.

Police argued a prison term would be a deterrent for others, case for samsung galaxy and Judge Down said the incident warranted a term of up to two years, but there were enough mitigating factors to apply home detention.

McGregor received nine months' home detention for the drink-driving charges and a two-year driving disqualification for both charges.

Conditions imposed on him include abstaining from drugs and alcohol, and undertaking alcohol assessment, along with 12 months of post-sentence monitoring.

Lawyer Scott Jefferson said McGregor was working hard to support his daughter, was deeply remorseful, and had full support from his victims.

"They do not bear any ill will towards him," he said.

McGregor had been told he may never fully recover physically from the crash.

A dozen or so supporters were in court on Wednesday and there were tears and obvious signs of relief as they heard the sentence would not be a custodial one.

One supporter said outside court that McGregor had been suffering severely since the crash, and jail would have only punished Ashlee.

"He may not be able to run down the beach with her ever again," she said.

Judge Down said the disability and rehabilitation required, nu skin product along with the conditions surrounding his need to care for his daughter, meant a prison sentence would have been disproportionately severe.

He believed McGregor, despite having previous convictions for breaching driving licence restrictions, was unlikely to ever commit similar offences.
